This End-User License Agreement ("EULA") governs the use of the Lightroom Presets & Luts mobile application ("App") provided by Lightroom Presets & Luts. By using the App, you agree to be bound by the terms and conditions set forth in this EULA.
a. Lightroom Presets & Luts grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial purposes.
b. You may not sublicense, distribute, or otherwise transfer the App to any third party.
a. You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
b. You may not modify, adapt, translate, or create derivative works based on the App.
c. You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices within the App.
a. Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
a. Some features or content within the App may be offered as part of a subscription service. By using these features or accessing this content, you acknowledge and agree that your subscription will be automatically renewed and billed at the applicable subscription rate unless you cancel it. You can manage your subscription settings by visiting the relevant platform's settings.
a. Lightroom Presets & Luts retains all rights, title, and interest in and to the App, including all intellectual property rights.
a. This EULA is effective until terminated by you or Lightroom Presets & Luts. You may terminate this EULA by uninstalling the App.
b. Lightroom Presets & Luts may terminate this EULA at any time without notice if you fail to comply with its terms.
a. THE APP IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
a. LIGHTROOM PRESETS & LUTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR USE OR INABILITY TO USE THE APP, (ii) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN, (iii) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP, (iv) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE APP BY ANY THIRD PARTY, OR (v) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT LIGHTROOM PRESETS & LUTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
a. This EULA shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.
